Welcome to Candor. These Terms & Conditions ("Terms") govern your use of our website and companion care services. By accessing our website or subscribing to our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
Candor provides remote, non-medical companion call services for older adults ("Seniors"). Our companions provide social engagement, conversation, and emotional support via telephone. Candor does not provide medical care, therapy, counseling, personal care, or emergency services of any kind.
Candor may record calls between companions and Seniors for quality assurance, training, safety, and service improvement purposes. By subscribing to our services, you acknowledge and consent to the recording of these calls on behalf of yourself and the enrolled Senior.
You must be at least 18 years of age to create an account and subscribe to Candor's services. By subscribing, you represent that you have the legal authority to enroll the designated Senior in our service and that you have obtained their consent to participate.
Candor offers monthly subscription plans at the prices listed on our website. By subscribing, you authorize Candor to charge the payment method on file on a recurring monthly basis until you cancel. Prices are subject to change with 30 days' written notice. All fees are in US dollars.
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle. Candor does not provide prorated refunds for partial months. To cancel, contact us at nat@candorcompanions.com.
Candor will use reasonable efforts to match each Senior with a compatible companion and to maintain the same companion for ongoing calls. However, we cannot guarantee a specific companion will always be available. We reserve the right to reassign companions at our discretion. Call scheduling is subject to companion availability.
Candor companions are not licensed medical professionals, therapists, counselors, or caregivers. Our companions do not provide:
If a companion observes signs of distress, cognitive changes, or a potential emergency during a call, they will follow Candor's emergency protocol, which may include contacting the designated emergency contact and/or local emergency services.
Candor is not an emergency service, crisis hotline, or suicide prevention service. In the event of a medical emergency, please call 911 immediately. While our companions are trained to recognize signs of distress and will escalate concerns according to our internal protocols, Candor does not guarantee detection of medical emergencies, mental health crises, or safety risks and shall not be liable for any failure to do so.
By subscribing to our services, you acknowledge and consent that Candor may, at its sole discretion, disclose information from companion calls — including call recordings, call notes, and details shared by the Senior during conversations — to the following parties when Candor reasonably believes the Senior's health, safety, or life may be at risk:
This disclosure may occur without prior notice to the subscriber or the Senior if Candor determines that the situation requires immediate action. Candor shall not be liable for any disclosure made in good faith to protect the health or safety of the Senior or any other person.
You agree to hold Candor harmless for any actions taken in good faith pursuant to this section, including but not limited to contacting emergency services, sharing call recordings or notes, or any consequences arising from such disclosure.
By subscribing to Candor's services, you acknowledge and agree that:
You voluntarily assume all risks associated with the Senior's participation in Candor's services and agree that Candor shall not be held liable for any injury, harm, decline in health, or death that may occur in connection with or during the provision of our services.
Candor makes no warranties, representations, or guarantees — express or implied — that our services will reduce loneliness, improve mental or physical health, prevent cognitive decline, or produce any specific health, emotional, or social outcome. Results vary by individual. Our services are intended to provide social engagement and companionship and should not be relied upon as a medical or therapeutic intervention.
Candor reserves the right to immediately end any call and/or terminate a subscriber's account without refund if the Senior or subscriber engages in behavior that is abusive, threatening, harassing, discriminatory, sexually inappropriate, or otherwise harmful toward a Candor companion. Candor also reserves the right to terminate service at our sole discretion if we determine that our service is not appropriate for the Senior's needs or circumstances.
As a subscriber, you agree to:
You are responsible for maintaining the confidentiality of your account information, including your login credentials and payment details. You agree to notify Candor immediately of any unauthorized access to or use of your account. Candor shall not be liable for any loss or damage arising from your failure to safeguard your account information.
All Candor companions undergo background checks and training prior to providing services. However, Candor does not guarantee the conduct of any individual companion beyond commercially reasonable vetting procedures. Candor reserves the right to terminate any companion's engagement at any time.
Candor's companions are a core part of our service and represent a significant investment in recruiting, vetting, training, and matching. You agree that during your subscription and for a period of twenty-four (24) months following the termination or cancellation of your subscription, you will not, directly or indirectly:
Liquidated damages: You acknowledge that a breach of this section would cause Candor substantial harm that is difficult to quantify. In the event of a breach, you agree to pay Candor liquidated damages in the amount of $15,000 per occurrence, in addition to any other remedies available to Candor at law or in equity, including injunctive relief. You agree that this amount is a reasonable estimate of Candor's damages and is not a penalty.
This provision shall survive the termination or cancellation of your subscription.
To the fullest extent permitted by law, Candor, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services, including but not limited to damages for loss of health, emotional distress, personal injury, or death. Candor's total liability for any claim arising from these Terms or our services shall not exceed the amount paid by you to Candor in the three (3) months preceding the claim.
Candor is a companionship service, not a healthcare provider. We make no representations or warranties regarding health outcomes, and our services are not a substitute for professional medical care.
You agree to indemnify and hold harmless Candor and its officers, directors, employees, companions, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of our services; your violation of these Terms; any inaccurate information you provide; any claim by the Senior or any third party related to the Senior's participation in our services; or your failure to ensure appropriate medical care for the Senior.
Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Arbitration shall take place in the State of Florida. You agree that any arbitration shall be conducted on an individual basis and not as a class action or class arbitration. You waive any right to participate in a class action lawsuit or class-wide arbitration against Candor.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
All content on the Candor website — including but not limited to text, graphics, logos, images, design elements, and software — is the property of Candor and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Candor content without our prior written consent.
Candor utilizes third-party services including but not limited to payment processors (Stripe), telecommunications providers, and cloud hosting services. Candor is not responsible for any failures, interruptions, errors, or security breaches caused by third-party service providers. Your use of third-party services is subject to their respective terms and privacy policies.
Candor shall not be liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, epidemics, war, terrorism, riots, government actions, power outages, internet or telecommunications failures, cyberattacks, or labor disputes. In the event of a force majeure event, Candor will make reasonable efforts to resume services as soon as practicable.
Your use of Candor's services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
Candor reserves the right to modify these Terms at any time. We will make reasonable efforts to notify subscribers of material changes via email or by posting a notice on our website. Continued use of our services after changes become effective constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Candor regarding the use of our services and supersede all prior agreements, representations, and understandings.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
